This privacy notice explains how we’ll collect, use and store your personal data if you apply to take part in Magners ‘Share the Craic’ comedy search, and if you are then selected to participate. It also gives you information about your legal rights granted under data protection laws.

Magners has partnered with experts from the comedy world to deliver this exciting opportunity. Each party is operating as a separate data controller for the purposes of this promotion.

The data controllers’ details are:

Magners GB Limited, Pavilion 2 The Pavilions, Bridgwater Road, Bristol, BS99 6ZZ.

Underbelly Limited, Diamond House 36-38 Hatton Garden, London, EC1N 8EB.

Bigger Agency Limited, 41 Great Portland Street, London, W1W 7LA.

Captivate Social (UK) Limited t/a Fabric, 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF.

If you have any questions about this privacy notice, or how your personal data will processed during this competition, please contact the Magners (C&C Group) Data Protection Officer by emailing GDPR@candcgroup.com.

This privacy notice was drafted in April 2026. We’ll contact you if we make any significant changes to it.

We won’t be able to consider your application or respond to your queries if you don’t provide certain personal data. It’s also important that the personal information we hold about you is correct and up to date, so please keep us informed if your personal information changes during your relationship with us.

1. Why we’ll use your personal data

Your personal data will be used to successfully plan and run the Magners Share the Craic comedy search. This includes the shortlisting for the regional heats and final selection processes, arranging travel and accommodation for the winner, and any media coverage including but not limited to, social media content captured throughout the competition process.

We may need to conduct background checks, including ‘basic’ criminal history checks, to ensure suitable participants are selected and to minimise reputational risk. If such checks are deemed necessary, the shortlisted participants will be asked to consent to this happening at that point in the process.

If necessary, your personal data will be used to manage issues or legal disputes if these arise during or following this promotional activity.

2. Our ‘lawful basis’ for using your personal data

For the initial phases of this promotion, we’ll rely on your consent to process your personal data by virtue of you completing and submitting an application for consideration.

Whilst there is no requirement or expectation that you will disclose ‘Special Category’ data, it is possible you might choose to share this information voluntarily e.g. in responding to questions posed during the application process. Our lawful basis is therefore explicit consent.

The legal basis for processing any criminal conviction and offence data during the background checks is also consent as outlined in Condition 29 of Schedule 1 of the Data Protection Act 2018.

Once the successful participants have been chosen and have agreed to participate, we will rely on ‘performance of a contract’ as the lawful basis to process personal data, in circumstances where consent is no longer the appropriate basis to use.

3. Passing your information to others

We’ll share your data with other people and organisations. We require these third parties to respect the security of your data and to use it legally. Where a third-party is acting as our ‘data processor’, they’ll act solely on our instructions and will only use your information for that specific purpose.

We may share your data with:

Other entities within the Magners parent company group (C&C Group plc), as part of our regular reporting activities, during analysis of the success of this promotional campaign, in the context of a business reorganisation or group restructuring exercise, or for system maintenance support and hosting of data.

The other parties involved in the organisation of the regional heats and Fringe event.

Companies that provide products and services, for example travel companies or venues used during the promotion.

Social media platform providers, such as Meta and Google for the purposes of promoting the comedy competition and spotlighting the participating comedians across social media.

Press and media outlets, as part of promotional activities throughout the competition process.

IT system providers, including data storage providers and their technical support teams, if necessary.

Official bodies, law enforcement agencies, insurers, our accountants, auditors, legal advisors etc where we must do so to comply with legal obligations, exercise or defend our legal rights, to prevent and detect crime or prosecute offenders, or to safeguard and protect our employees, consumers, or other individuals.

4. International transfers

Your personal data may be transferred to and stored in locations outside the UK. This will typically occur when we use service providers located in the EU (e.g. accommodation and travel providers), or where our IT providers host our data elsewhere in the world. These data transfers require us to follow certain rules under data protection law to ensure that your data will be adequately protected, so we’ll only transfer data to countries that have been confirmed as protecting personal data to UK or EEA standards, or where contractual commitments are in place which make sure the data is protected to these standards.

Please contact the Magners Data Protection Officer if you need more information on this.

5. How long we keep your personal data

Your personal data is only kept for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any operational, legal or reporting requirements, and in order to defend our legal rights.

We have determined that:

Applicants who do not reach the shortlist stage: your personal data will be retained for one month

Social media posts and content will remain available online beyond the end of the competition period. If you ask us to remove content that includes your personal data, we will delete or stop using that content where it is under our control. However, content published online may continue to be available outside our channels, for example where it has been reposted by other users, or indexed by search engines. We do not control these copies and cannot guarantee their removal.

6. Your rights

Under data protection law you have the right to:

Request access to your personal information (commonly known as a ‘data subject access request’). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Your right to complain to a data protection regulator

For UK residents:

Please note that in due course and as part of the UK Data (Use and Access) Act 2025, individuals will be required to raise their complaint with Magners as the data controller before escalating it to the Information Commissioner’s Office (ICO).
